These Terms of Use are an agreement between you and Metin Ertekin for the Foodmetric app and related services. By using Foodmetric, you agree to these Terms and the Privacy Policy.

1. Eligibility and accounts

You must provide accurate information, protect your account and sign-in credentials, and take responsibility for activity under your account. Guest use may have a limited allowance associated with the device. If you are below the age required to enter a contract or consent to data processing where you live, a parent or legal guardian must authorize your use.

2. Service purpose and AI estimates

Foodmetric provides meal, water, weight, calorie, and macro tracking, plus AI-assisted nutrition estimates from photos or text. Results are estimates that vary with photo quality, portions, recipes, and data sources. You are responsible for reviewing and correcting a result before saving or relying on it.

Foodmetric is not a medical device, diagnosis, treatment, or emergency service. Consult a qualified professional about medical conditions, allergies, eating disorders, pregnancy, or specialized nutrition needs. Do not make medical decisions based only on an app estimate.

3. Your content and consent to AI processing

You retain your rights in photos, text, and records you provide. You grant us a limited permission to process, transmit, and technically transform that content only to provide the feature you request, secure the service, and operate Foodmetric. Before an AI analysis begins, the in-app disclosure and consent concerning transfer of selected content to Google Vertex AI / Gemini applies.

4. Acceptable use

You may not use the service unlawfully, harmfully, fraudulently, or abusively; bypass security or usage limits; send excessive automated requests; upload another person's data without permission; or reverse engineer or misuse the app or infrastructure. We may limit access when needed to address security or abuse.

5. Free use and Premium

As of these Terms' last-updated date, the free tier includes 3 total AI analyses per account or anonymous device. Foodmetric Premium includes up to 30 AI analyses per day while the entitlement is active. The daily allowance may reset at the local day boundary, and security and reasonable-use limits apply. The app displays your current allowance.

Premium may be offered as a monthly or yearly auto-renewing subscription. If the app offers a one-time extra-analysis pack, it supplies only the number of extra analyses shown in the store purchase sheet. No free trial or introductory period is promised unless it is explicitly shown for the specific product in the app and store purchase sheet.

6. Price, renewal, cancellation, and refunds

• The local price, currency, billing period, and offer terms shown in the purchase sheet control your purchase.
• A subscription automatically renews at the end of each period unless canceled in your store account. Cancel within the time required by the store, generally at least 24 hours before the period ends.
• Apple App Store or Google Play manages billing, cancellations, and refunds under its rules. Foodmetric does not receive your full card details.
• You can use Restore Purchases. Deleting your Foodmetric account does not cancel a store subscription; cancel the subscription separately in store settings before deleting the account.

7. Changes and availability

We may change the service for security, maintenance, or product development. We will provide reasonable notice of material changes affecting the essential nature of a paid service. Maintenance, networks, stores, third-party providers, or events beyond reasonable control may cause interruptions; uninterrupted or error-free operation is not guaranteed.

8. Suspension, termination, and account deletion

We may suspend or terminate access if you breach these Terms or law, create a security risk, or abuse the service. You may stop using Foodmetric and delete your account in the app or at https://foodmetricai.com/account-deletion/es-ES. Payment, liability, intellectual-property, and dispute terms that must logically survive deletion will remain in effect.

9. Intellectual property and third parties

The Foodmetric brand, app design, software, and Foodmetric-created materials belong to their respective rights holders. You receive a limited, revocable, non-transferable license for personal, non-commercial use. Separate terms from Apple, Google, Supabase, Firebase, RevenueCat, and data providers may apply to their services.

10. Additional iOS terms

If you obtained the app from the Apple App Store, Apple's Standard End User License Agreement also applies. Apple is not responsible for providing the Foodmetric service or support. If these Terms conflict with mandatory App Store terms, the mandatory store terms control.

11. Disclaimers and liability

To the extent permitted by law, the service is provided “as is” and “as available.” We do not guarantee nutrition or AI-estimate accuracy. Subject to mandatory consumer rights, liability for indirect or unforeseeable losses, incorrect user inputs, or reliance on estimates is limited to the extent the law permits. Nothing excludes liability that cannot legally be excluded.

12. Governing law, changes, and contact

Subject to mandatory consumer-protection and conflict-of-law rules, these Terms are governed by the laws of the Republic of Türkiye. If we materially change the Terms, we will update the date and provide in-app notice when appropriate. Questions can be sent to ertekin.developer@gmail.com.
